Trademark registration is the process of legally protecting a unique symbol, logo, name, or design that distinguishes a business or company’s goods or services from others. In Nigeria, the Trademarks, Patents and Designs Registry under the Commercial Law Department of the Federal Ministry of Industry, Trade, and Investment is responsible for trademark registration.
A registered trademark grants the owner exclusive rights to use the mark and prevents others from using a similar mark that could cause confusion. It is valid for an initial period of 7 years and can be renewed indefinitely for subsequent periods of 14 years.

Process
Steps involved in this compliance service
- Trademark Search: Conduct a preliminary search at the Trademarks Registry to ensure the proposed trademark is not already registered or pending.
- Prepare and Submit Application: Complete and submit the trademark application form and attach the required documents.
- Acknowledgment and Filing: Upon submission, the applicant receives an acceptance letter, acknowledgment letter and a filing number.
- Formal Examination: The Registry examines the application to ensure it meets formal requirements (e.g., completeness of documents, payment of fees).
- Publication in the Trademarks Journal: If the application passes the formal examination, the trademark is published in the Trademarks Journal to allow for objection by third parties. The publication process typically takes around 12 -24 months.
- Objection Period: After publication, there will be a 60-day period during which third parties can file objections to your trademark.
- Substantive Examination: If no objections are raised within the 60-day window, we will proceed to apply for the trademark certificate, the Registry conducts a substantive examination to ensure the trademark is distinctive and does not conflict with existing trademarks.
- Approval and Registration: If the application is successful, the Registrar issues an official trademark registration certificate.
